Regulatory Context

Four Requirements. One Answer.

This reality has long been addressed by law, and requirements are growing step by step: psychosocial risk assessment mandatory since 2013, crisis early warning since 2021, ESG claims must be evidenced from September 2026, Human Sustainability KPIs to be documented from fiscal year 2027.

§ 5 ArbSchG
Psychosocial Risk Assessment: Mandatory for all employers since 25 October 2013. From 2026, at least 5% of all companies will be inspected annually. Rarely implemented validly in practice. HSflow closes this gap. § 6 ArbSchG prescribes no particular format and no particular survey instrument; the measures are determined by the employer.
CSRD / ESRS S1
Human Sustainability Reporting: Auditable KPIs on psychosocial risks of the workforce. After Omnibus I (EU 2026/470): reporting obligation from fiscal year 1 January 2027, first report due 2028. Threshold: >1,000 employees and >€450m turnover.
§ 1 StaRUG
Crisis Early Warning System: Since 1 January 2021, all limited liability companies must establish a crisis early warning system. Which risks to capture is left open by the law. Psychosocial risks directly affect the performance and stability of an organisation. HSflow makes them measurable and documents them.
